Interests of the beneficiaries

The beneficial interests provided in the terms of the trust.

Joint tenants with the right of survivorship

Joint tenants with the right of survivorship and "community property with the right of survivorship" includes co-owners of property held under circumstances that entitle one or more to the whole of the property on the death of the other or others but excludes forms of co-ownership registration in which the underlying ownership of each party is in proportion to that party's contribution.

Jointly held property

Property held in the name of two or more persons under an arrangement in which all holders have concurrent interests and under which the last surviving holder is entitled to the whole of the property.

Least restrictive treatment alternative

The treatment plan and setting that infringe in the least possible degree with the right of the patient to liberty and that are consistent with providing needed treatment in a safe and humane manner.

Licensed physician

Any medical doctor or doctor of osteopathy who is either:

  • Licensed in this state.
  • A full-time hospital physician licensed in another state and serving on the staff of a hospital operated or licensed by the United States government.
Local administration

Administration by a personal representative appointed in this state pursuant to appointment proceedings described in Arizona Revised Statutes, Chapter 3.

Local personal representative

Any personal representative appointed in this state pursuant to appointment proceedings described in Arizona Revised Statutes, Chapter 3 and excludes foreign personal representatives who acquire the power of a local personal representative pursuant to Arizona Revised Statutes, Section 14-4205.

Mandatory income interest

The right of an income beneficiary to receive net income that the terms of the trust require the fiduciary to distribute.

Medical director of a mental health treatment agency

A psychiatrist, or other licensed physician experienced in psychiatric matters, who is designated in writing by the governing body of the agency as the person in charge of the medical services of the agency for the purposes of this chapter and includes the chief medical officer of the state hospital.

Medical director of an evaluation agency

A psychiatrist, or other licensed physician experienced in psychiatric matters, who is designated in writing by the governing body of the agency as the person in charge of the medical services of the agency for the purposes of this chapter and may include the chief medical officer of the state hospital.

Member of the beneficiary's family

A beneficiary's spouse, descendant, stepchild, parent, stepparent, grandparent, brother, sister, uncle or aunt, whether of the whole or half blood or by adoption.

Member of the minor's family

The minor's parent, stepparent, spouse, grandparent, brother, sister, uncle or aunt, whether of the whole or half blood or by adoption.

Mental disorder

A substantial disorder of the emotional processes of a person, thought, cognition or memory. Mental disorder is distinguished from:

  • Conditions that are primarily those of drug abuse, alcoholism or intellectual disability, unless, in addition to one or more of these conditions, the person has a mental disorder.
  • The declining mental abilities that directly accompany impending death.
  • Character and personality disorders characterized by lifelong and deeply ingrained antisocial behavior patterns, including sexual behaviors that are abnormal and prohibited by statute unless the behavior results from a mental disorder.
Mental health provider

Any physician or provider of mental health or behavioral health services involved in evaluating, caring for, treating or rehabilitating a patient.

Mental health treatment agency

The state hospital or a health care agency that is licensed by the department and that provides those services that are required of the agency by this chapter.

Minor

A person who is under eighteen years of age.

Mortgage

Any conveyance, agreement or arrangement in which property is encumbered or used as security.  Mortgage does not include leases or easements.

Net income

The total receipts allocated to income during an accounting period minus the disbursements made from income during the period, plus or minus transfers under this article to or from income during the period.

Nonresident decedent

A decedent who was domiciled in another jurisdiction at the time of the death of the decedent.

Outpatient treatment

Outpatient treatment or "combined inpatient and outpatient treatment" means any treatment program not requiring continuous inpatient hospitalization.
