No. If the value of all personal property minus liens and encumbrances, is not more than $75,000, and at least 30 days have passed since the death, you may not need the probate process. Personal property includes things like cash, bank accounts, stocks, bonds, cars, jewelry, and money owed to the decedent. If the assessed value of the real property (land) minus liens and encumbrances is $100,000 or less, and at least 6 months has passed since the death, you may not need the probate process.
